Welcome to FoodPOS Cloud.
These Terms and Conditions (“Terms”) govern your access to and use of our web application, FoodPOS Cloud, available at https://foodpos.cloud.
By creating an account or using our services, you agree to comply with and be bound by these Terms. If you do not agree, please discontinue use immediately.


1. Definitions

  • “Service” refers to the FoodPOS Cloud web application and all related features, tools, and functionalities.

  • “User,” “You,” or “Your” refers to any individual or business that accesses or uses the Service.

  • “We,” “Us,” or “Our” refers to FoodPOS Cloud and its team or authorized representatives.


2. Use of Service

You agree to use the Service only for lawful business purposes and in accordance with these Terms.
You must:

  • Provide accurate, current, and complete information during registration.

  • Maintain the confidentiality of your account credentials.

  • Be responsible for all activities that occur under your account.

You may not:

  • Use the Service for fraudulent, illegal, or unauthorized purposes.

  • Attempt to reverse engineer, copy, or exploit any part of the system.

  • Interfere with or disrupt the security or performance of the platform.


3. Account Registration

To access most features, you must create an account. You agree to:

  • Keep your login information confidential.

  • Notify us immediately at support@foodpos.cloud if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.


4. Subscription and Payments

FoodPOS Cloud offers both free and paid subscription plans.

  • By subscribing to a paid plan, you agree to provide valid payment information.

  • Payments are processed securely through our third-party payment partner (e.g., PayPal).

  • Subscription fees are billed on a recurring basis (monthly or annually) unless canceled.

  • You may cancel your subscription anytime; however, no refunds will be issued for partial billing periods.

We reserve the right to modify our pricing or features with prior notice.


5. Free Trial

We may offer a free trial period for new users.
Once the trial expires, you will be required to subscribe to a paid plan to continue accessing premium features.
If no payment method is provided after the trial, your account may be limited or deactivated.


6. Data Ownership

You retain full ownership of all data you upload or input into FoodPOS Cloud, including your business information, sales records, and customer data.

By using the Service, you grant us permission to:

  • Store, process, and back up your data as part of system operations.

  • Use aggregated, non-identifiable data for analytics and service improvement.

We will never sell or disclose your data to third parties without your consent, except as stated in our Privacy Policy.


7. Service Availability

We strive to keep FoodPOS Cloud available 24/7. However, we may occasionally experience downtime due to:

  • Maintenance or updates

  • Technical issues beyond our control

  • Force majeure events (e.g., natural disasters, internet outages)

We are not liable for any loss of profit, business interruption, or data resulting from service unavailability.


8. Intellectual Property

All content, features, and software within FoodPOS Cloud—including logos, design, text, and source code—are owned by FoodPOS Cloud and protected by copyright and intellectual property laws.

You may not reproduce, distribute, or modify any part of the Service without our written permission.


9. Termination

We may suspend or terminate your account without prior notice if:

  • You violate these Terms

  • You misuse the Service

  • You fail to pay subscription fees

Upon termination, your access to the Service will end, and your data may be deleted after a reasonable period, in accordance with our Data Retention Policy.


10. Limitation of Liability

To the maximum extent permitted by law:

  • FoodPOS Cloud is not liable for indirect, incidental, or consequential damages resulting from your use of the Service.

  • We make no warranties, express or implied, about the Service’s performance, reliability, or suitability for your specific needs.

Your sole remedy for dissatisfaction with the Service is to discontinue its use.


11. Modifications

We reserve the right to modify or update these Terms at any time. Changes will be posted on this page with the updated date.
Your continued use of the Service after such updates constitutes your acceptance of the revised Terms.


12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.
